8. Additional Exclusions & Non-Defect Conditions
8.1 Additional Exclusions
In addition to the exclusions set out in Section 2, the following are also excluded from the scope of this Limited Warranty:
- Glass tops and panels, electrical fittings and fixtures (such as bulbs and switches), and rubber or plastic components are subject to ageing through environmental exposure; warranty cover on these items ceases at the time of acceptance of the product.
- Customisations carried out at the customer’s request, including changes in size or dimensions; product distortion arising from repair work carried out by unauthorised persons; and any defects or damage arising from the workmanship of third-party maintenance providers or the use of spare parts and supplies not sourced from Nilkamal.
- Comfort preference, where there is a mismatch between the actual comfort of the Product and the comfort expected by the customer, is a matter of subjective preference and not a warrantable defect.
8.2 Conditions Not Considered as Defects
The following characteristics and conditions are inherent to the materials and construction of Nilkamal furniture products and shall not be treated as manufacturing defects for the purposes of this Warranty Policy:
- Rubberwood Products – Rubberwood products and parts are constructed using finger-joints, and the resulting parting lines are a feature of this construction method, not a defect.
- Natural Wood Products (Sheesham, Acacia and Mango Wood) – The following are natural characteristics of these woods and not defects:
- Natural Wood has a distinctive, irregular grain structure that is hand-finished to a fine polish by skilled craftsmen. The shine of this polish may vary from the initial supplied finish as it ages with usage.
- As each piece is hand-finished from an entirely natural material, variations in knots, grain detailing, mineral deposits, colour and minor imperfections are unique to each piece and form part of its individual character.
- Visible knots are characteristic of this hardwood and add to the individuality of each piece; they are not a defect.
- Two-toned finishes occur naturally where a piece is made from a random combination of heartwood and sapwood. This colour variation is intentional and adds to the charm of Natural Wood furniture.
- Natural Wood is hygroscopic and expands or contracts with seasonal changes in moisture. Joints are designed and crafted with adequate clearance to accommodate this natural expansion and contraction, which is not a defect.
- All wooden furniture is rendered free of borers, pests and termites during manufacture through high-temperature and high-pressure wood treatment. Subsequent infestation by termites, borers or fungus is attributable to local atmospheric conditions of high humidity, compounded by inadequate cleaning, and is not a manufacturing defect.
- Electrical Wiring – Bending at the border of wires used in product wiring, occurring as a result of the normal movement or folding of parts, is not a defect.
- Mechanism Sounds – Increased friction and resulting audible sounds from moving parts, developing over time through normal wear and tear, are not a defect.
- Mirror Coating – Deterioration of the reflective coating on a mirror over time, and the resulting reduction in reflection quality, is due to ageing and is not a defect.
